La Ruta del Clima

El trabajo destaca desafíos, como la desigualdad de género en el interés de participación. Además, se señala que el trabajo de campo coin- cidió con la aprobación de un Plan de Ordenamiento Territorial, generando resistencia y limitando la participa- ción efectiva de la población en la in- vestigación. El estudio busca avanzar hacia futuros justos, reconociendo estrategias de resistencia en contex- tos de crisis climática, colonialismo y abandono neoliberal.

The study identified preexisting elements that heighten community vulnerability and endeavored to establish the historical, economic, and socioenvironmental backdrop to assess the impacts of climate change-related phenomena. This context was essential in determining the effects of climate change and their consequences in the form of loss and damage.

A Loss and Damage Fund (LDF) responds to a structural demand for justice. At COP27, the LDF was created by Decisions 2/CP.27 and 2/CMA.4. The LDF has the objetive to respond to loss and damage and a mandate that includes a focus on addressing loss and damage. To accomplish the operationalization of the Loss and Damage Fund a Transitional Committee (TC) was tasked with generating recommendations. In the fifth meeting of the TC, a recommendation was agreed. A proposal where the World Bank would anchor the LDF was issued to be taken by parties at COP28

El cambio climático es definido por la CMNUCC como la acción humana directa o indirecta que ha alterado la composición de la atmósfera mundial y que se suma a la variabilidad natural del clima observado por periodos de tiempo comparables. (UN, 1992 Art. 1) La Corte Interamericana de Derechos Humanos ha mencionado que en virtud de la Convención Marco de Cambio Climático (CMNUCC) se derivan obligaciones de los Estados por parte de daños causados por el cambio climático.

The 2023 United Nations Climate Change Conference (COP28) will take place from November 30 to December 12 at Dubai’s Expo City. This year’s host, the United Arab Emirates (UAE), will preside over the conclusion of the first Global Stocktake (GST) and key negotiations leading to the operationalization of the loss and damage fund that was agreed to last year at COP27 in Sharm El-Sheikh, Egypt.

Climate change is one of the most pressing challenges of our time, with profound and widespread effects across the planet. Latin American countries are particularly vulnerable to these shocks, given their rich natural heritage and dependence on climate-sensitive economic sectors such as agriculture, fisheries, and tourism. Given this reality, the adoption of solid and effective legislation on climate change becomes essential to address this problem from a human rights-approach and lay the foundations for a transition to a more sustainable future.
